C-2 Approve Settlement of lawsuit of Jenna Garlington v. The School Board of Clay County, et al (Item pulled to Discussion by Mr. Bickner)

Issue/Rationale

On June 18, 2010, the Lakeside Junior High School Junior Honor Society rented the Black Creek Amenity Center, which was a part of Eagle Harbor’s Clubhouse services, for the purpose of their end of the year party.  Jenna Garlington was an employee with the management company which maintained the amenity center. Ann Smith was a volunteer for the Honor Society function and was a parent of one of the attendees.  Ms. Smith tried unsuccessfully to light the gas grill. One of the employees of the amenity center then lit the grill and it exploded causing injury to Jenna Garlington. She suffered burns to her hands, arms and legs all of which required medical care. She continues to have skin discoloration on parts of her body as a result.  Allegations of negligence were filed against Ann Smith, the School Board of Clay County, the design firm for the building, the builder, the gas company the community development district and the management company. Settlement was reached at mediation at which Carol Studdard and Bruce Bickner were in attendance.



Recommended Action

Superintendent recommends approval.
